Scope and provider
These Terms and Conditions (“Terms”) form an agreement between you and Sunalytiq s.r.o. (“Sunalytiq”, “we”, “us” or “our”) and govern your use of sunalytiq.com, the Sunalytiq portal and related services (together, the “Service”).
By creating an account, accepting an order or pilot agreement, or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.

Accounts and access
You must provide accurate registration information and keep it current. You are responsible for safeguarding credentials and for activity performed through your account. Do not share an individual account with another person.
Tell us promptly at info@sunalytiq.com if you suspect unauthorised access. We may suspend access where reasonably necessary to protect the Service, users or data.
You must be at least 18 years old and legally capable of entering into these Terms. The Service is intended primarily for professional and business use.
The Sunalytiq service
Sunalytiq brings solar production, consumption, weather, forecast, diagnostic and related operational information into a connected interface. The exact features, data sources, sites, limits, support and service level available to you may be described in an order form, pilot agreement or other written agreement.
Where a separate written agreement conflicts with these Terms, the separate agreement controls for that subject.
Your data and permissions
You retain ownership of data, files and information submitted by you or your organisation (“Customer Data”). You grant Sunalytiq a non-exclusive right to host, copy, process, transmit and display Customer Data only as needed to provide, secure, support and improve the Service and to meet legal obligations.
You are responsible for ensuring that you have all rights and permissions needed to provide Customer Data to us, including personal data relating to employees, contractors or other people.
We may use information that has been irreversibly aggregated or anonymised so that it no longer identifies you, an individual site or your organisation, for service analytics and improvement.
Acceptable use
You must not:
- use the Service unlawfully or to infringe another person’s rights;
- attempt to gain unauthorised access to accounts, systems, data or networks;
- introduce malware, malicious code or content intended to disrupt the Service;
- probe, scan or test vulnerabilities without our prior written permission;
- circumvent access, rate, security or usage restrictions;
- reverse engineer or copy protected parts of the Service except where applicable law expressly permits it;
- use automated means in a way that creates an unreasonable load or interferes with other users;
- submit data you are not entitled to use or that contains unlawful content.
Insights and operational decisions
Forecasts, diagnostics, performance indicators and recommendations are decision-support information. They may be affected by source data quality, sensor availability, weather uncertainty, configuration and assumptions.
Sunalytiq does not replace qualified engineering, electrical, safety or financial advice. You remain responsible for operational, maintenance, investment and safety decisions and for following equipment documentation and applicable rules.
Do not use the Service as the sole control system for emergency, life-safety or grid-protection functions.
Availability, changes and beta features
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation unless a separate service level agreement says otherwise. Maintenance, security events, provider outages and circumstances outside our reasonable control may affect availability.
We may update the interface and features to improve security, performance or usefulness. Features marked preview, pilot, beta or similar may be changed or discontinued and may be less reliable than generally available features.
Third-party integrations are also subject to the availability, permissions and terms of their providers.
Intellectual property
Sunalytiq and its licensors retain all rights in the Service, software, design, documentation, models, branding and other materials, excluding Customer Data. Subject to these Terms and any applicable order, we grant you a limited, non-exclusive, non-transferable and revocable right to use the Service during the agreed term for your internal purposes.
If you provide feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.
Fees and taxes
Fees, billing dates, currency and payment terms are stated in the applicable order, proposal or pilot agreement. Unless that document says otherwise, fees are exclusive of applicable taxes and are non-refundable once the relevant service period has begun, except where mandatory law requires a refund.
Suspension and termination
You may stop using the Service at any time. Account cancellation is available in portal settings or by contacting us. Contractual subscriptions remain subject to the termination terms in the applicable order or agreement.
We may suspend or terminate access if you materially breach these Terms, fail to pay agreed fees, create a security risk, use the Service unlawfully or where we are legally required to do so. Where practical, we will give notice and an opportunity to remedy the issue.
After termination, access ends. Provisions that by nature should survive—including payment obligations, intellectual property, confidentiality, liability and governing law—remain effective.
Warranties and liability
The Service is provided with reasonable care and skill. Except for express commitments in a written agreement and rights that cannot legally be excluded, the Service is provided “as is” and “as available”.
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings. Sunalytiq’s total aggregate liability arising from the Service is limited to the fees paid or payable for the Service during the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of confidentiality or data-protection obligations, or any liability that cannot be excluded under applicable law.
Privacy
Our Privacy Policy explains how we process personal data. Where Sunalytiq processes personal data solely on behalf of a business customer, the parties may enter into a separate data processing agreement.
Governing law and disputes
These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules. Courts with jurisdiction over Sunalytiq’s registered office will have exclusive jurisdiction, unless mandatory law or a separate written agreement requires otherwise.
Before starting formal proceedings, each party should make a reasonable attempt to resolve the dispute through good-faith discussion.
Changes to these terms
We may update these Terms to reflect changes to the Service, law or security requirements. The current version and effective date will be published here. For material changes affecting registered users, we will provide reasonable notice. Continued use after the effective date constitutes acceptance where permitted by law.
